Terms and Conditions

Please read carefully. These Terms are a binding agreement between you and Muffin Market™ regarding your use of our marketplace, website, mobile application, and related services (collectively, the “Service”). By accessing or using the Service, you confirm that you have read, understood, and agree to these Terms and our linked policies. If you do not agree, do not use the Service.
1. Introduction and acceptance
These Terms of Service, together with our Privacy Policy, Cookie Policy, Payment Policy, Refund Policy, Cancellation Policy, and Prohibited & Restricted Items policy (collectively, the “Terms”), govern your use of the Service. We may publish additional guidelines or feature-specific rules on the Service; those are incorporated by reference where they apply to you.
Our use of cookies and similar technologies on the website is described in the Cookie Policy. Personal data practices are described in the Privacy Policy.
By creating an account, downloading our app, browsing this website, or otherwise using the Service, you accept these Terms. If you use the Service on behalf of a business or organization, you represent that you have authority to bind that entity, and “you” includes that entity.
2. About Muffin Market
Muffin Market™ (“we,” “us,” “our”) operates an online marketplace that connects customers with independent local vendors—shops, restaurants, delivery providers, and similar businesses. We provide the marketplace platform (software, listings, messaging, and discovery tools). Unless we clearly identify ourselves as the seller for a specific offering, we are not the seller of vendor products or services.
The Service may be offered through different domains or regional experiences (for example muffinmarket.com and muffinmarket.in). The Muffin Market entity that provides your Service may vary by region; applicable law and dispute resolution are described in Sections 16 and 17.
3. Eligibility
To use the Service, you must:
- Be at least 18 years old, or the age of majority in your jurisdiction, whichever is higher (or use the Service only with verifiable guardian consent where local law allows and we permit it).
- Not have been previously suspended or removed from the Service for breach of these Terms, unless we expressly reinstate you.
- Use the Service only in compliance with applicable laws and regulations in your location.
We may refuse or revoke access if we reasonably believe you do not meet these requirements.
4. Accounts and security
Most features require an account. When you register, you agree to provide accurate, complete, and current information and to keep it updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
Notify us promptly through the Contact section on our home page or in-app Support if you believe your account has been compromised. We are not liable for losses arising from unauthorized use of your account where you failed to safeguard credentials or notify us without undue delay.
We may require verification (for example phone or email confirmation) to protect the community and comply with law.
5. Marketplace role and vendor relationships
Muffin Market is a marketplace operator, not the seller of vendor products or services unless we say otherwise in writing.
- Orders placed with vendors create a relationship between you and the vendor. Muffin Market is not a party to that sale unless we clearly identify ourselves as the seller.
- Vendors are responsible for their listings, pricing, availability, fulfillment, quality, taxes, licenses, and compliance with local laws.
- As a marketplace, we do not process customer payments for vendor orders; those are made directly to vendors. See the Payment Policy.
- Refunds for vendor orders are handled between you and the vendor, not by Muffin Market. See the Refund Policy.
- Order cancellations follow vendor rules and in-app flows where available. See the Cancellation Policy.
6. Vendor listings and user content
The Service may allow users and vendors to submit content such as business listings, product descriptions, photos, reviews, messages, and order-related information (“User Content”). You retain ownership of User Content you submit, subject to the licenses below.
By submitting User Content, you grant Muffin Market a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and distribute that content as needed to operate, promote, and improve the Service (including formatting for display and sharing order details with relevant parties).
You represent and warrant that:
- You own or have the rights and permissions needed to submit the User Content and to grant the license above.
- Your User Content does not infringe any third-party intellectual property, privacy, publicity, or other rights.
- Your User Content is accurate to the best of your knowledge and complies with these Terms and applicable law.
We do not guarantee the accuracy of User Content posted by others. We may remove, restrict, or disable access to User Content that we believe violates these Terms, applicable law, or our community standards, or that poses risk to users or the platform, with or without notice. See our Prohibited & Restricted Items policy for examples of listings that are not allowed on Muffin Market.
If you believe content on the Service infringes your intellectual property rights, contact us through the home page Contact section with sufficient detail for us to review the claim. We may request additional information and will respond as required by applicable law.
7. Muffin Market business services
Businesses may purchase services from Muffin Market for operations on the platform (for example listings, features, or support packages). When Muffin Market is the seller of those services:
- Pricing, billing, and payment terms are disclosed at purchase or in your service agreement.
- Payments, invoices, and refunds for those services are governed by our Payment Policy and Refund Policy.
- Cancellation requests must be submitted through the Support menu in the smartphone app and are handled on a case-by-case basis, as described in our Cancellation Policy.
8. Acceptable use
You agree to use the Service lawfully and respectfully. You must not:
- Use the Service for any illegal purpose or to offer illegal goods or services.
- Post false, misleading, fraudulent, or infringing content.
- Harass, threaten, defame, or harm other users, vendors, or Muffin Market staff.
- Impersonate any person or entity, or misrepresent your affiliation.
- Attempt to bypass security, access another user’s account without permission, or interfere with platform operation.
- Use automated tools (bots, scrapers, crawlers) to access the Service except through interfaces we expressly authorize in writing.
- Upload malware or engage in activity that could damage or overload the Service.
- Manipulate ratings, reviews, or platform statistics through multiple accounts or artificial activity.

We may investigate violations and suspend or terminate accounts that breach this section or pose risk to the community.
9. Intellectual property
Muffin Market™ names, logos, software, website design, and other platform materials (excluding User Content) are owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. The Muffin Market logo and artwork are copyrighted works. Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal or internal business purposes as intended by the product.
You may not copy, modify, distribute, sell, or reverse engineer any part of the Service except where applicable law expressly permits. No rights are granted except as stated in these Terms.
10. Third-party links and services
The Service may contain links to third-party websites, payment methods, maps, or tools. Vendors and payment providers are independent third parties. We do not control and are not responsible for their content, policies, pricing, fulfillment, or conduct.
Your use of third-party services is at your own risk and subject to their terms. Direct payments you make to vendors are transactions between you and the vendor, not Muffin Market.
11. Disclaimers
TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICE AND THIS WEBSITE ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
We do not warrant that the Service will be uninterrupted, secure, or error-free, or that vendor listings, prices, or availability are accurate. We are not responsible for vendor performance, product quality, delivery timing, or disputes arising from transactions between you and vendors.
12. Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, MUFFIN MARKET AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM:
- Your use of or inability to use the Service;
- Vendor transactions or direct payments between you and vendors;
- User Content posted by you or third parties; or
- Third-party services linked from or used with the Service.
Our total liability for claims relating to Muffin Market–sold business services shall not exceed the fees you paid us for those services in the twelve (12) months before the event giving rise to the claim, except where applicable law requires otherwise. Nothing in these Terms limits liability that cannot be limited under mandatory consumer protection law in your jurisdiction.
13. Indemnity
You agree to defend, indemnify, and hold harmless Muffin Market and its affiliates from claims, damages, losses, and expenses (including reasonable legal fees) arising from your misuse of the Service, your User Content, your violation of these Terms, or your dealings with vendors or third parties, except to the extent caused by our gross negligence or willful misconduct.
14. Changes to these Terms
We may update these Terms from time to time. When we make changes, we will update the effective date at the top of this page and, where appropriate, provide notice in the app, by email, or on this website. Unless we state a different effective date on this page, changes take effect on the effective date shown above or when posted — we do not use an advance-notice waiting period before updated Terms apply. Continued use of the Service after the effective date constitutes acceptance, subject to any additional consent required by mandatory law. If you do not agree to revised Terms, stop using the Service and see our Account and Data Deletion page regarding account closure.
15. Termination
These Terms remain in effect while you use the Service. You may stop using the Service at any time. We may suspend or terminate your access at any time if you breach these Terms, if required by law, or if we discontinue the Service, with or without notice where permitted.
Upon termination:
- Your right to use the Service ends immediately.
- Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution) will survive.
- You remain responsible for amounts owed to Muffin Market for business services incurred before termination.
You are responsible for retaining copies of information you need from your account. We may delete account data according to our Privacy Policy and retention practices.
16. Governing law
These Terms and disputes with Muffin Market about the platform, your account, privacy, or Muffin Market–sold business services are governed by the laws of India, without regard to conflict-of-law rules, subject to mandatory consumer rights that cannot be waived by contract.
Claims for personal injury or tangible property damage arising from your use of the Service are governed by the laws of the state, territory, or country where the injury or damage occurred, to the extent required by applicable law.
Disputes about vendor orders (product quality, delivery, or payment to a vendor) are governed by applicable law between you and the vendor. Muffin Market is not a party to those disputes unless we clearly identify ourselves as the seller for that transaction.
Users in India, the United States, and other regions may have mandatory rights under consumer protection, data protection, or other laws that cannot be limited by these Terms.
17. Resolving disputes with Muffin Market
We want to resolve concerns quickly and fairly. Most issues are fixed through Support. This Section applies to disputes between you and Muffin Market (for example about your account, the platform, privacy, or fees paid to Muffin Market). It does not apply to disputes about a vendor order — see Section 5 and our Refund Policy.
17.1 Three types of disputes
- Vendor orders (you and the vendor): Contact the vendor directly about product quality, delivery, or refunds. Muffin Market may offer optional Support but is not a party to the sale and these dispute-resolution steps do not bind the vendor.
- Platform (you and Muffin Market): Follow the steps in Sections 17.2–17.5 below.
- Business services (vendor and Muffin Market): If you purchase listing or platform services from Muffin Market as a business, additional terms in your vendor or service agreement may apply, including dispute resolution.
17.2 Step 1 — Informal resolution
Before starting formal proceedings against Muffin Market, you agree to contact us in good faith for at least 30 calendar days through in-app Support or the Contact section on our home page so we can try to resolve your concern.
17.3 Step 2 — Formal notice
After you have tried informal resolution under Section 17.2, and if that does not resolve the dispute, you must send a written description of your claim to our Grievance Officer (see our Privacy Policy — To: Grievance Officer, Muffin Market; grievance-officer@muffinmarket.in). Include your name, account identifier (for example registered mobile number), a description of the facts, and the relief you seek. We will acknowledge receipt and respond within timelines required by applicable law (including e-commerce and data-protection grievance rules where they apply).
Privacy-related complaints may also be handled under the grievance process in our Privacy Policy. Where applicable law provides a separate data-protection appeal path, that path remains available and is not waived except to the extent permitted by law.
17.4 Step 3 — Mediation or online dispute resolution (optional)
If the dispute remains unresolved after Step 2, you and Muffin Market may agree in writing to attempt mediation or online dispute resolution (ODR) for up to 60 calendar days before further proceedings. Either party may decline mediation.
17.5 Step 4 — Arbitration or permitted court
If Steps 17.2 and 17.3 do not resolve the dispute (and mediation under 17.4 was not used or did not succeed), any remaining dispute or claim between you and Muffin Market arising out of or relating to these Terms or the Service shall be resolved by binding individual arbitration under the Arbitration and Conciliation Act, 1996 (India), rather than in court before a judge or jury, except as set out in this Section.
- Individual proceedings only: Disputes with Muffin Market must be brought only in an individual capacity. You and Muffin Market agree not to bring or participate in any class, collective, consolidated, or representative action against the other to the maximum extent permitted by applicable law. This does not limit non-waivable rights under the Consumer Protection Act, 2019, data-protection grievance or appeal rights, or other mandatory statutory remedies.
- Arbitration rules: Arbitration shall be conducted by a single arbitrator, in the English language, with seat in India (arbitration institution and city to be specified in the arbitration notice or as required by applicable institutional rules and law).
- Fees: For qualifying individual consumer claims against Muffin Market, we will pay reasonable arbitration filing and administrative fees beyond any amount a court of competent jurisdiction would require you to pay to bring a similar claim, except where applicable law requires otherwise or an arbitrator determines a claim is frivolous or brought for an improper purpose. Each party bears its own attorneys’ fees unless the arbitrator’s award provides otherwise.
- Small claims and consumer forums: Either party may bring qualifying claims in a Consumer Disputes Redressal Commission or other small or summary court with jurisdiction, instead of arbitration, where applicable law permits.
- Condition precedent: You may not commence arbitration or court proceedings against Muffin Market for a platform dispute until you have completed Steps 17.2 and 17.3 in good faith. Muffin Market may seek to stay or dismiss proceedings that do not comply with this requirement.
- Grandfathering: The arbitration agreement in this Section does not apply to litigation that was already pending against Muffin Market in a court of competent jurisdiction before the effective date of these updated Terms.
17.6 No waiver of mandatory rights
Nothing in these Terms limits rights that applicable law does not allow to be limited, including mandatory consumer protections, data-principal rights, or access to government or regulatory complaint mechanisms.
